SUNDAY CUPS - FULL RULESET
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Subject to all applicable laws, regulations, and ordinances. VOID WHERE PROHIBITED BY LAW. The FACEIT PUBG Sunday Cups (the “Tournament”) begins on 11 November 2018 at 11:00 A.M. GMT, and takes place every Sunday thereafter until otherwise stated by the Tournament Organizer. Each Event (the “Event”) of the Tournament is self-standing and taking place over one day starting at 12:00 P.M. GMT and ending at the close of play of the Finals (approximately 06:00 A.M. GMT of the following day (as applicable in the local time of the participating country) (the “Tournament Period”). All times in the Tournament refer to Greenwich Mean Time (“GMT”).The Tournament, or an Event of the Tournament, may be cancelled, rescheduled or otherwise modified by the Tournament Organizer, in its sole and exclusive discretion, by giving notice to the Players.
- TOURNAMENT ORGANIZER: The Tournament is organized by Face IT Limited (the “Organizer” and/or also “FACEIT”), Millbank Tower, 25th Floor, 21-24 Millbank, SW1P 4QP London, England, United Kingdom.
- THE GAME: The game shall be the latest and current version of PlayerUnknown’s BattleGround (“PUBG”).
- ELIGIBILITY: The Tournament is open only to Players (each a “Player,” and, collectively, the “Players”) who, at the time of entry and at all times during the Tournament:
(i) have active Steam®, PUBG and FACEIT accounts; (ii) own or have lawful access to the PUBG video game; (iii) are legal residents and physically located in one of the following countries: Åland Islands, Albania, Andorra, Armenia, Austria, Azerbaijan, Bahrain, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Faroe Islands, Finland, France, Georgia, Germany, Gibraltar, Greece, Guernsey, Holy See, Hungary, Iceland, Iraq, Ireland, Isle of Man, Israel, Italy, Jersey, Jordan, Kazakhstan, Kuwait, Kyrgyzstan, Latvia, Lebanon, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Oman, Palestine, Poland, Portugal, Qatar, Romania, Russian Federation, San Marino, Saudi Arabia, Serbia, Slovakia, Slovenia, Spain, Svalbard and Jan Mayen, Sweden, Switzerland, Tajikistan, Turkey, Turkmenistan, Ukraine, United Arab Emirates, United Kingdom of Great Britain and Northern Ireland, Uzbekistan, Yemen, Anguilla, Antigua and Barbuda, Argentina, Aruba, Bahamas, Barbados, Belize, Bermuda, Bolivia, Bonaire, Bouvet Island, Brazil, Canada, Cayman Islands, Chile, Colombia, Costa Rica, Cuba, Curaçao, Dominica, Dominican Republic, Ecuador, El Salvador, Falkland Islands, French Guiana, Greenland, Grenada, Guadeloupe, Guatemala, Guyana, Haiti, Honduras, Jamaica, Martinique, Mexico, Montserrat, Nicaragua, Panama, Paraguay, Peru, Puerto Rico, Saint Barthélemy, Saint Kitts and Nevis, Saint Lucia, Saint Martin, Saint Pierre and Miquelon, Saint Vincent and the Grenadines,
Sint Maarten, South Georgia and the South Sandwich Islands, Suriname, Trinidad and Tobago, Turks and Caicos Islands, United States of America, Uruguay, Venezuela, Virgin Islands; and (iv) are over the age of 16 years old in their jurisdiction of permanent legal residence as of the time of Entry (defined below). Any participant who has not yet reached the age of majority in his/her state/province/country must obtain the permission of his/her parent or legal guardian in order to enter and play, and if the participant wins an event of the Tournament, the Prize (defined below) will be awarded in the name of his/her parent or legal guardian.
Employees, officers, and directors of the Organizer or their parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers, web masters, (collectively, the “Tournament Entities”) and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. The Tournament Organizer reserves the right to verify the eligibility of participants and winners. Participation constitutes entrant’s full and unconditional agreement to: (i) these Official Rules for the Tournament (“Official Rules”); and, (ii) the Tournament Organizer’s decisions, which are final and binding in all matters related to the Tournament.
Further, participation constitutes Player’s permission (except where prohibited by law) to use Player’s name, nickname, in-game nickname, city, state/province/country, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter developed, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

The Tournament will be held on http://www.FACEIT.com per the above Schedule and Players will need an active account on the FACEIT platform, Steam and PUBG in order to participate.
Players may register and compete in one event scheduled for their region; provided, however, Players who have been disqualified from the event or Players who have been banned on the FACEIT platform may not compete.
Players are only allowed to take part into one event per Sunday in their own region. Players who attempt to sign up and play into more than one tournament will be disqualified from one of the them.
Registrations stay open for each event until the first round starts.
The Tournament is an online and regionally based competition, where teams (each a “Team”, and collectively, the “Teams”) that are comprised of four (4) Players compete to play the PUBG videogame, using their PC/Steam version of the game. In order to participate in the Tournament, each Team (and its individual Players) must meet the following criteria at all times or risk disqualification and/or forfeiture at the sole discretion of the Organizer:
- Employ four (4) Players who are in compliance with all participation requirements,
including these official rules; 2. Employ one (1) Player who is duly authorized to act as a Team Representative (the Team
Representative) on behalf of the Team and its Players; 3. Comply with all policies, terms and conditions of Steam and FACEIT;
4. Have three out of their four Players legally residing and physically located in one of the
eligible countries for the region in respect of which the Event is being held; and 5. Read and agree to be bound by these Official Rules.
The eligible countries for the “Europe Sunday Cup” are the following countries: Åland Islands, Albania, Andorra, Armenia, Austria, Azerbaijan, Bahrain, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Faroe Islands, Finland, France, Georgia, Germany, Gibraltar, Greece, Guernsey, Holy See, Hungary, Iceland, Iraq, Ireland, Isle of Man, Israel, Italy, Jersey, Jordan, Kazakhstan, Kuwait, Kyrgyzstan, Latvia, Lebanon, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Oman, Palestine, Poland, Portugal, Qatar, Romania, Russian Federation, San Marino, Saudi Arabia, Serbia, Slovakia, Slovenia, Spain, Svalbard and Jan Mayen, Sweden, Switzerland, Tajikistan, Turkey, Turkmenistan, Ukraine, United Arab Emirates, United Kingdom of Great Britain and Northern Ireland, Uzbekistan, Yemen.
The eligible countries for the “Americas Sunday Cup” are the following countries: Anguilla, Antigua and Barbuda, Argentina, Aruba, Bahamas, Barbados, Belize, Bermuda, Bolivia, Bonaire, Bouvet Island, Brazil, Canada (excluding Quebec), Cayman Islands, Chile, Colombia, Costa Rica, Cuba, Curaçao, Dominica, Dominican Republic, Ecuador, El Salvador, Falkland Islands, French Guiana, Greenland, Grenada, Guadeloupe, Guatemala, Guyana, Haiti, Honduras, Jamaica, Martinique, Mexico, Montserrat, Nicaragua, Panama, Paraguay, Peru, Puerto Rico, Saint Barthélemy, Saint Kitts and Nevis, Saint Lucia, Saint Martin, Saint Pierre and Miquelon, Saint Vincent and the Grenadines, Sint Maarten, South Georgia and the South Sandwich Islands, Suriname, Trinidad and Tobago, Turks and Caicos Islands, United States of America, Uruguay, Venezuela, Virgin Islands.
Players from outside of these eligible regions may NOT participate in the Tournament.
Players must make sure to check in and confirm their participation for EACH event they intend to play in. Check-ins open one (1) hour before the scheduled event start time and close thirty (30) minuted before the event scheduled start time.
Players who have not checked in and confirmed their participation at least thirty (30) minutes before the event’s scheduled start time will be automatically removed from the event.
2.3 No Shows
If all Players of a Team do not connect to the game lobby within the allowed time to connect which is stated in the match room, the Team will not be rewarded with any points for the match.
If some Players of a Team do not connect to the game lobby within the allowed time to connect as stated in the match room, the Team’s placement will be determined by the points of the connected Players.
3 Tournament Structure
The event is open to all eligible Players and will be played in a round based bracket. Teams signed up for the event will be matched against other Teams in their respective round. Each Round consist of three (3) matches played where final standings and kills of each count towards the round score. After all matches in the round have been played, the Team with the best overall scores will advance to the next round.
The number of rounds might change based on the amount of signups in the event. Matches will automatically be created as soon as the event starts.
Tournaments will be played according to the format detailed in the table below:
At the end of each round, the Teams that have qualified to advance to the next one will automatically advance. All rounds will be played according to the schedule. If the event is delayed beyond the scheduled starting times, the next round will be started as soon as possible.
Matches within the same round are started automatically as soon as the previous match ends.
In the event that multiple Teams are eligible to advance to the next round, the following tiebreakers will be applied to determine the qualifying Team in the order as stated below:
1.) number of wins in the round; 2.) number of kills in the round; and 3.) best individual match in the round (overall points in the match).
3.2 Game Settings
Game Version: The Tournament will use the latest version of PUBG. It is the Players’ responsibility to ensure their game is updated before the event starts. If Players fail to download and update their game in time for their matches, they may be disqualified.
External Softwares: external tools or software that may alter in-game settings are not permitted in the event. If in doubt whether software and/or tools my or could be used or not, please contact the FACEIT staff via email at firstname.lastname@example.org before the event starts.

Game Server Locations: The preferred location for the Europe Sunday Cup is pc-eu and the preferred location for the Americas Sunday Cup is pc-na. The event will be run on servers located and provided by PUBG Corp. and the Organizer has no control over their stability and availability. Server location may be different in the event of stability issues in the preferred location. The Organizer also reserves the right to cancel the event in the event no game servers are available in any location.
Points System: The Unified Point System for competitive PUBG gameplay as described in the table below will be adopted. Killpoints will be evaluated at 16 points per kill.
The three (3) Teams that reach the first, second and third placements in the event in their region in accordance with the Official Rules will be considered the Tournament winners (the “Winners,” each a “Winner”) and will be entitled to a prize (each a “Prize, or collectively, “Prizes”). Except where legally prohibited, the Winners (specifically, each winning Player) will be required to complete and return (or have their parent/legal guardian sign if a Winning Player is a minor), an Affidavit of Eligibility, Liability & Publicity Release and any required tax documentation in order to claim his/her Prize.
In the event that a Winner is disqualified for any reason, such Winner will be deemed to have forfeited the Prize with no further rights and the Prize will, in Organizer’s sole and exclusive discretion, be distributed equally among the remaining Winners as described below. Noncompliance with the foregoing, failure to abide by these Official Rules, or return of the Prize notification as non-deliverable may result in disqualification and naming of a replacement Team.
THE WINNER(S) IS/ARE SUBJECT TO VERIFICATION BY THE ORGANIZER, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE TOURNAMENT. A PLAYER AND/OR TEAM IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL PLAYER’S AND TEAMS’ ELIGIBILITY HAS BEEN VERIFIED AND PLAYER AND TEAM HAVE BEEN NOTIFIED THAT VERIFICATION IS COMPLETE, REGARDLESS OF WHAT THE GAME PLAY MAY INDICATE.
For this Tournament, the following Prizes will be awarded. There will be a total Prize pool of $2,000 USD per region distributed amongst the winning three (3) Teams as follows: 1st Place: 1000$
2nd Place: 700$ 3rd Place: 300$
Taxes on the Prizes provided hereunder are the sole responsibility and liability of the Winners. Estimated Retail Value (“ERV”) of each Prize will be determined by the Winner’s allocated portion of the Prize Pool. Actual Retail Value (“ARV”) of each Prize will be the ERV of such Prize.
5 Match Procedure
5.1 Before the Match
As soon as the match goes into the ready state, Players can join the in-game lobby by searching for the lobby name which is provided in the FACEIT match room overview.
To find the lobby in game, Players need to head over to Custom Game, then Normal and use the search functionality present in the game.
Please read and follow the steps detailed below:
1.) Copy the Private lobby name from the FACEIT match room
2.) Go to the custom match list in PUBG (see screenshot below)
3.) Search for the custom lobby by pasting the Private lobby name into the search box, or
look for the lobby by using the filters: Status “Waiting”, Region “EU” or “NA”, Perspective “FPP”, Team “4P”, Match “Private”, Battle Scale “Team”.
5.2 During the match
If a Player has any issues during the match, they should contact the FACEIT Admin Team through the “CONTACT ADMIN” button inside the Match Room.
All communication with the FACEIT Admin Team is expected to be in English. All communication in game and FACEIT match room chat is recommended to be in English.
If a Player disconnects during a game, the match must continue. The disconnected Player may reconnect at any point. If a Player or Team disconnects during the game and cannot reconnect, the match must continue and the kills and placement of the disconnected Players will be taken into account at the end of the match.
In the event the server crashes or other issues lead to all Player disconnecting from the game, or the match not being able to be played, FACEIT Admins may, at their own discretion, restart the whole match.
5.3 After the match
Upon completion of the match, the results will be automatically fetched and updated in the match room.
It is mandatory for each Player participating in the event to take a screenshot of their death screen clearly showing their placement and number of kills. It is also mandatory for each Player participating in the event to have in-game replays enabled and saved.
Each Player in the event must keep their screenshots and in-game replays for 14 days after the tournament has been concluded.
Only the Organizer reserves the right to request screenshots and/or replays from any Player taking part in the event. Other Players do not have the right to request screenshots and/or replays from other event’s players or to FACEIT admins.
Failing to provide screenshots and/or replays to a FACEIT admin will result in disqualification from the event and/or in voiding the game result score.
6 Rules and violations
6.1 Forbidden in-game actions
The following actions are strictly prohibited during a game and will result in your account being suspended and the offending Player being disqualified from further participation in the Tournament:
- Using any form of external script;
- Using bugs which change the game principle (e.g. dropping below the map);
- Using any 3rd party software that is not permitted by PUBG Corp. and/or FACEIT and that can give an unfair advantage to a Player or Team;
- Moving through walls, floors and roofs; and
- Not having a full and up to date version of the game.
The usage of any 3rd party software as described above will lead to immediate disqualification.
Examples of such 3rd party software are:
- Radar Hacks
- Macros (e.g.: recoil macros)
- Teleporting hacks or flying car hacks
- Editing the game files to gain unfair advantages (e.g.: removing grass or shadows)
Issues during a match (from the beginning of the match to the end) must be reported immediately to a FACEIT Admin using the “CONTACT ADMIN” button and the appropriate evidence needs to be provided. Those issues cannot be reported post the event (after the fact). Failure to immediately report an issue will mean acceptance of the issue.
A Player may be cautioned and receive a ban if he/she commits any of the following offences:
- Refuses to follow FACEIT Admin instructions;
- Shows dissent by word or action towards other Players and/or the Organizer;
- Uses insulting language and/or gestures towards other Players, the Organizer and PUBG Corp.;
- Is guilty of unsportsmanlike behaviour in a match or otherwise acts in manner that is detrimental to or incompatible with the brand standards of the Organizer and/or PUBG Corp.;
- Ghosting (i.e. watching video streams and/or listening to live coverage of Player’s own match while the match is still in progress);
- Spamming; and
- Misleading FACEIT Admins.
Decisions will be executed without delay in Organizer’s sole and exclusive discretion. Offending Players may be disqualified from further participation in the Tournament and/or be banned, in the sole discretion of the Organizer.
6.3 Player accounts
Players must have a valid FACEIT account, in good standing, and their PUBG account must be connected to their FACEIT account. All information registered on the accounts need to be true, accurate and up to date. Account sharing or attempting to play the event with another persons’ PUBG accounts will lead to immediate disqualification and/or banning.
Stand-ins are not allowed in the Tournament, unless stated otherwise in writing.
7.2 Player, Party/Team names and Avatars
Player and Party/Team Names/Avatars are the responsibility of the Players provided however, Player and Party/Team Names/Avatars shall be consistent with general standards of decency, shall not be derogatory to any Tournament Entities, profane or offensive, shall not violate the proprietary rights of any third party, shall not include any company name, brand, logo or sponsorship, shall have no religious or political names or associations, and shall be subject to change as required by the Organizer, in their sole and exclusive discretion.
Players and/or Teams failing to comply with the above the rule or the Organizer’s direction or decisions in relation thereto may be banned and/or disqualified.
7.3 Ingame Name/Avatars
Player and Party/Team Names/Avatars are the responsibility of the Players and Teams provided however, Player and Party/Team Names/Avatars shall be consistent with general standards of decency, shall not be derogatory to any Tournament Entities, profane or offensive, shall not violate the proprietary rights of any third party, shall not include any company name, brand, logo or sponsorship, shall have no religious or political names or associations, and shall be subject to change as required by the Organizer, in its sole and exclusive discretion.
Players and/or Teams failing to comply with the above the rule or the Organizer’s direction or decisions in relation thereto may be banned and/or disqualified.
7.4 Live streaming
Players and Teams are allowed to livestream their games, however, must do so with a delay set to a minimum of 600 seconds (10 minutes).
Any form of collusion or match-fixing in order to manipulate the results of this event will result in disqualification and may result in a permanent ban on FACEIT. To report any match-fixing allegations, please send us an email with evidence to email@example.com.
7.6 Conflict of Interest
Teams and Players should not have any financial interest in the success of any Team that they are competing against. To participate in the event, Players and Teams are required to affirm that they have no business entanglement (including, but not limited to, shared management and services or support, shared ownership of entities, licensing, and loans) with any other participating Team or its Players. If Teams or Players have an agreement, business arrangement or relationship that may be of concern, then please reach out to the Tournament officials for further discussion.
7.7 Finality of Decisions
FACEIT and its Tournament officials reserve the right to immediately remove or restrict ANY strategy or bug without it being mentioned in this Official Rulebook.
FACEIT and its Tournament team reserve the right to make final and non-appealable decisions, that are not specifically delineated in these rules and regulations to preserve fair play and sportsmanship.
The Organizer may request that Players refrain from communicating (either privately or publicly via social media or otherwise) any confidential information related to the Tournament until after such Tournament information has been made public.
8 Prize Restrictions
Any and all applicable country, federal, provincial, state, and local taxes and all fees, costs and expenses related to acceptance and use of Prize or travel provided hereunder and not specifically stated herein, including, but not limited to, VAT taxes, tariffs or duties and/or other expenses, are the responsibility solely of winning Players and Teams. Prizes cannot be substituted, assigned, or transferred by winning Players and/or Teams; however, the Organizer reserves the right to make equivalent prize substitutions at its sole and exclusive discretion. Only the number of Prizes stated in these Official Rules are available to be won in the Tournament. If, by reason of a print or other error, more Prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described above
from among all eligible claimants making purportedly valid claims to award the advertised number of Prizes available.
GENERAL CONDITIONS: WARNING: ANY ATTEMPT BY A PLAYER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE AND/OR SPONSOR/FACEIT PLATFORM ASSOCIATED WITH THIS TOURNAMENT OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, FACEIT RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Organizer’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Organizer reserves the right, in its sole discretion to disqualify any Player and/or Team it finds to be attempting to tamper with or undermine the entry process, the website, and/or the legitimate operation of the Tournament; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. The failure of the Organizer to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Organizer (accepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.
The Organizer and its agents are not responsible for (1) any incorrect or inaccurate information, whether caused by Players, printing errors or by any of the equipment or programming associated with or utilized in the Tournament; (2) technical issues or failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or hardware, software or internet issues; (3) unauthorized human intervention in any part of the entry process or the Tournament; (4) technical or human error which may occur in the administration of the Tournament or the processing of game play or registrations or check-ins; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Player’s participation in the Tournament or receipt or use or misuse of any Prize. If technical issues arise, matches should be continued as normal by the Players once such issues are resolved; in the case of a server crash, difficulty in contacting the network or other unforeseen circumstances, it is the Player’s responsibility to contact the Organizer for assistance. If, for any reason, the Tournament is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Organizer, which corrupt or affect the operation, administration, security, fairness, integrity or proper conduct of this Tournament, the Organizer may, in its sole discretion, void any suspect entries and (a) modify the Tournament or suspend the Tournament to address the impairment and then resume the Tournament in a manner that best conforms to the spirit of these Official Rules in their absolute discretion; and/or (b) award the Prize to an alternate potential Winner in accordance with the Winner selection criteria described above.
LIMITATIONS OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS TOURNAMENT, EACH PLAYER AGREES THAT ORGANIZER, AND ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY PLAYERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY OR PARTICIPATION IN THIS TOURNAMENT OR IN ANY TOURNAMENT RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY, OR ANY AND ALL TAX LIABILITIES INCURRED AS A CONSEQUENCE OF THE PAYMENT OF ANY PRIZES. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS TOURNAMENT, PLAYER AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS TOURNAMENT OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.
PUBLICITY: EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THIS TOURNAMENT SHALL CONSTITUTE AND SIGNIFY THE PARTICIPANT’S AGREEMENT AND CONSENT THAT FACEIT AND ITS DESIGNEES MAY USE THE PARTICIPANT’S NAME, GAME NIKCNAME, NICKNAME OR ALIAS, CITY, STATE, PROVINCE, COUNTRY, IMAGE OR LIKENESS, GAME FOOTAGE (INCLUDING, BUT NOT LIMITED TO, THAT FROM ANY MATCH THAT HAS BEEN LIVE STREAMED, BROADCAST, OR RECORDED), BIOGRAPHICAL INFORMATION AND/OR PRIZE INFORMATION IN CONNECTION WITH THE TOURNAMENT FOR PROMOTIONAL, ADVERTISING OR OTHER PURPOSES, WORLDWIDE, IN ANY AND ALL MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING THE INTERNET, WITHOUT LIMITATION AND WITHOUT FURTHER PAYMENT, NOTIFICATION, PERMISSION OR OTHER CONSIDERATION, EXCEPT WHERE PROHIBITED BY LAW. ALL ENTRIES AND MATERIALS SUBMITTED TO FACEIT OR ITS AGENTS IN CONNECTION WITH THE TOURNAMENT (“SUBMISSIONS”), ALONG WITH ALL COPYRIGHT, TRADEMARK AND OTHER PROPRIETARY RIGHTS ASSOCIATED THEREWITH, ARE HEREBY IRREVOCABLY AND FREE OF CHARGE ASSIGNED BY PLAYER TO FACEIT AND BECOME THE PROPERTY OF FACEIT UPON SUBMISSION, AND SUBMISSIONS WILL NOT BE RETURNED TO ANY
PLAYER. FURTHERMORE, PLAYERS UNDERSTAND THAT FACEIT AND/OR ITS AGENTS WILL VIDEO, PHOTOGRAPH AND OTHERWISE DOCUMENT THE TOURNAMENT (“FOOTAGE”). PLAYER AGREES THAT, AS BETWEEN THE PARTIES, FACEIT SHALL OWN THE FOOTAGE AND SUBMISSIONS AND THAT FACEIT, ITS DESIGNEES, ASSIGNEES AND LICENSEES SHALL HAVE THE RIGHT TO EDIT, EXPLOIT, ADAPT, DISTRIBUTE, POST, CREATE DERIVATIVE WORKS FROM, AND OTHERWISE USE THE FOOTAGE OR SUBMISSIONS, IN WHOLE OR IN PART, AND IN COMBINATION WITH OTHER MATERIALS, IN ANY MANNER, FOR ANY ADVERTISING, PROMOTIONAL, TRADE, COMMERCIAL OR OTHER PURPOSES IN ANY AND ALL MEDIA, NOW KNOWN OR HEREAFTER DEVELOPED, WORLDWIDE IN PERPETUITY, WITHOUT FURTHER PAYMENT OR CONSIDERATION, NOTIFICATION OR PERMISSION. TOURNAMENT ENTITIES SHALL NOT INCUR ANY LIABILITY WHATSOEVER TO THE EXTENT TOURNAMENT ENTITIES CHOOSE TO REFRAIN FROM ANY EXPLOITATION OF THEIR RIGHTS HEREUNDER. EACH PLAYER WILL INDEMNIFY THE TOURNAMENT ENTITIES, RELEASED PARTIES AND ANY LICENSEE OF FACEIT AGAINST ALL CLAIMS, DAMAGES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE COUNSEL FEES AND LEGAL EXPENSES) ARISING OUT OF ANY BREACH OF THESE TERMS.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS TOURNAMENT, INCLUDING EACH WEBSITE ASSOCIATED WITH THIS TOURNAMENT AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. DISPUTES AND GOVERNING LAW: Except where prohibited, Player agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Tournament or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts situated in London, England; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Tournament, but in no event solicitors/attorneys’ fees or other costs of bringing a claim; (3) under no circumstances will Player be permitted to obtain awards for, and Player hereby
waives all rights to claim, indirect, punitive, incidental, exemplary, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, and, (4) in no event shall Players rescind this agreement or seek injunctive or any other equitable relief. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, and/or the rights and obligations of the Player and FACEIT in connection with the Tournament, shall be governed by, and construed in accordance with, the laws of England, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than that of England.
