IMPORTANT UPDATES TO THE OFFICIAL RULES

UPDATE - BRACKET FINALS

If your Online Qualifier has an "A" bracket and a "B" bracket, the final round of each bracket - which is the semi-final round of the Online Qualifier - will be decided by a Best of Three (BO3) series.

UPDATE - CHECK-IN TIMING 2 HOURS

In an effort to improve the player experience, we are now opening check-in for each Online Qualifier two (2) hours before the scheduled start time. FaceIt will send you a reminder around the time check-in opens.

Players who have not checked-in and confirmed their participation at least thirty (30) minutes before the applicable Online Qualifier’s scheduled start time will be automatically removed, though they have option to re-register during that thirty (30) minute window if there are still spaces available.

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE CHANCES OF WINNING. Subject to all applicable laws, regulations, and ordinances. VOID OUTSIDE EUROPE (AS DEFINED BELOW), AND WHERE PROHIBITED BY LAW IN THE UNITED STATES AND CANADA. The NHL Gaming™ World Championship (the “Tournament”) begins March 24, 2018 at 9:00 A.M. ET and ends June 19, 2018 at the close of play of the World Finals (defined below) (approximately 11:00 P.M. ET (as applicable in the local time of the participating country) (the “Tournament Period”). All times in the Tournament refer to Eastern Time (“ET”) unless otherwise indicated.

The Tournament is sponsored by NHL Enterprises, L.P., NHL Enterprises Canada, L.P., and NHL Enterprises B.V. (together, the “Sponsor”), 1185 Avenue of the Americas, New York, NY 10036, USA.

The Tournament is open only to players (each a “Player,” and, collectively, the “Players”) who, at the time of entry and at all times during the Tournament:
(i) have an active XBOX LIVE® (“XBL”) or PlayStation® Network (“PSN”) account;
(ii) have a FACEIT (as defined below) account and agree to the FACEIT terms and conditions relating to service, data and privacy;
(iii) own or have access to the NHL® 18 video game;
(iv) are legal residents and physically located in Europe, the fifty (50) United States (including the District of Columbia), or Canada; and
(v) are at least sixteen (16) years of age or older. Any participant who has not yet reached the age of majority in his/her state/province/country and is at least the age of sixteen (16) must obtain the permission of his/her parent or legal guardian in order to enter and play, must be accompanied by his/her parent or legal guardian in the event he/she advances to the Live Regional Finals and/or World Finals (each as defined below), and if the participant wins the Live Regional Finals or the World Finals, the Prize (defined below) will be awarded in the name of his/her parent or legal guardian.

Employees, officers, directors, agents and representatives of Sponsor, the National Hockey League (“NHL”), its member teams, NHL Interactive CyberEnterprises, LLC, Face IT Limited (“FACEIT”), NBCUniversal/Comcast, Rogers, Viasat, Electronic Arts, any venues in connection with the Tournament, and their respective parents, subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfilment, and marketing agencies, website providers, web masters, (collectively, the “Tournament Entities”) and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household (whether related or not) are not eligible to enter or win. Sponsor and/or FACEIT reserve the right to verify the eligibility of Players and Winners (as defined below). Participation constitutes Player’s full and unconditional agreement to: (i) these Official Rules for the Tournament (“Official Rules”); (ii) the FACEIT policies (as available at support.faceit.com); and (iii) Sponsor’s and/or FACEIT’s decisions, which are in their absolute discretion and which are final and binding in all matters related to the Tournament.

Further, participation constitutes permission from Players (or in Canada, Players who advance to the Live Regional Finals and World Final), except where prohibited by law, to use Player’s name, city, state/province/country, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter developed, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

Based on the size of the applicable entry pool, Sponsor and FACEIT may determine that the applicable Online Qualifier be concluded within one day, in their discretion. However, when registering, Player agrees to play both days, if required. Sponsor and FACEIT will notify Players of the schedule/start time for a second day, if necessary. Moreover, Sponsor and FACEIT may update the start times for PS4 Online Qualifier 2 and XBOX Online Qualifier 2 by providing notice on the Tournament page beginning at the time of check-in. Players should be prepared to play at the updated start time.

Live Regional Finals

Each of the three (3) regions will have its own Live Regional Finals. The top two (2) Players who advance to the final round of each Online Qualifier per region advance to the Live Regional Finals.

World Finals
 
After the Live Regional Finals conclude, the two (2) Players who advance to the final round in each region qualify for the final stage, the World Finals, making six (6) Players in total.

2 Registration

The Online Qualifiers will be held on http://www.FACEIT.com using XBL or PSN, as applicable, per the above Schedule and Players will need an active account on the FACEIT platform and XBL and/or PSN in order to participate.

Players may register and compete in all four (4) Online Qualifiers scheduled for their region; provided, however, Players who have won any of the previous Online Qualifiers may NOT participate in any further Online Qualifiers in any region.

Registrations stay open for each Online Qualifier up until the respective bracket for that Online Qualifier goes live as scheduled provided, however, Sponsor may in its discretion limit the number of Players for any Online Qualifier.
2.1 Regions

This Tournament is open to Players who are legal residents of, and are physically located in, the fifty (50) U.S./D.C., Canada or Europe. For clarity, a Player may only play in the eligible region in which he/she legally resides and is located. However, if a Player legally resides in one eligible region, but is physically located in another eligible region, the respective Player is only eligible to participate in the region in which that Player is currently physically located. If a Player is not a resident of and located in an eligible region, he/she may not participate.

The European Region (“Europe”) is comprised of: ANDORRA, ALBANIA, ARMENIA, AUSTRIA, ÅLAND ISLANDS, AZERBAIJAN, BOSNIA AND HERZEGOVINA, BELGIUM, BULGARIA, BELARUS, SWITZERLAND, CYPRUS, CZECH REPUBLIC, GERMANY, DENMARK, ESTONIA, SPAIN, FINLAND, FAROE ISLANDS, FRANCE, UNITED KINGDOM, GEORGIA, GUERNSEY, GIBRALTAR, GREECE, CROATIA, HUNGARY, IRELAND, ISLE OF MAN, ICELAND, ITALY, JERSEY, LIECHTENSTEIN, LITHUANIA, LUXEMBOURG, LATVIA, MONACO, REPUBLIC OF MOLDOVA, MONTENEGRO, REPUBLIC OF MACEDONIA, MALTA, NETHERLANDS, NORWAY, POLAND, PORTUGAL, ROMANIA, SERBIA, SWEDEN, SLOVENIA, SVALBARD AND JAN MAYEN ISLANDS, SLOVAKIA, SAN MARINO, TURKEY, HOLY SEE (VATICAN CITY STATE).

Players from outside of these eligible regions may NOT participate in the Tournament.
2.2 Check-In

Players must make sure to check in and confirm their participation for EACH Online Qualifier they want to play in. Check-ins open forty-eight (48) hours before the scheduled Tournament start time.

Players who have not checked in and confirmed their participation at least thirty (30) minutes before the Online Qualifier’s scheduled start time will be automatically removed from the Online Qualifier. Players removed for not having checked in have the option to re-register during that thirty (30) minute time window.
3 Qualification Process

In order to qualify for the Live Regional Finals, Players can register for any, or all, of the four (4) Online Qualifiers for their region, subject to the terms below.

Each Online Qualifier consists of a single elimination bracket. At the start of each Online Qualifier, the FACEIT platform randomly seeds and matches opponents against each other.

By winning their matches, Players advance in the bracket. The final two (2) Players of every Online Qualifier advance to the applicable Live Regional Finals; however, the finals of each Online Qualifier will be played out to determine seeding and eligibility for the applicable USD $5,000 Prize listed below.

Winners of each Online Qualifier will receive the high seed, in turn runners-up will receive the low seed. Other seeding will be as set forth below.

Live Regional & World Finals

Every Live Regional Final will feature the eight (8) Players (four (4) winners and four (4) runners-up) from the applicable Online Qualifier.

At the Live Regional Finals, Players will compete for the top two (2) spots in order to qualify for the World Finals, scheduled to be played in Las Vegas, NV, USA.

Multiple Registrations

Players may register and participate in all of the Online Qualifiers of their region as long as they did not qualify for the Live Regional Finals in any of the previous Online Qualifiers.


Elimination

If after the conclusion of the fourth and final Online Qualifier for their region a Player did not qualify for the Live Regional Finals, the respective Player will be eliminated and will not be eligible to travel and participate in the subsequent offline stages of the Tournament.

Seeding

For the Online Qualifiers stage, there will be random seeding.

The Live Regional Finals will be played out in a Double-Elimination bracket with seeds based on the outcome of the Online Qualifiers, specifically as follows:

1) XBOX Qualifier #1 Winner vs XBOX Qualifier #2 Loser
2) XBOX Qualifier #2 Winner vs XBOX Qualifier #1 Loser
3) PS4 Qualifier #2 Winner vs PS4 Qualifier #1 Loser
4) PS4 Qualifier #1 Winner vs PS4 Qualifier #2 Loser

The winners of (1) and (2) above will play each other and the winners of (3) and (4) above will play each other. Likewise, the losers of (1) and (2) above will play each other and the losers of (3) and (4) will play each other in the losers’ bracket.

For the World Finals, the six (6) Players will be placed into one Round Robin group and each Player will play each of the other five (5) Players one time. The top two (2) players from the Round Robin stage will advance to a Best-Of-Three (BO3) final round of the World Finals. The top two (2) players are determined based on 1) overall record, 2) head-to-head results, 3) goal differential, 4) total goals scored, and 5) if the tie remains, a coin flip administered by Sponsor.

The winner of the World Finals will be crowned champion of the Tournament.
3.1 Game Settings

Each game must be created using the following settings:

The Player on the left in the Match Room on the FACEIT platform shall create the Online Versus lobby in NHL 18. That Player is responsible for setting up the lobby with the correct settings as detailed below. If the incorrect settings were used and it is deemed by an admin that the Player affected the outcome of the game, this may result in the hosting Player forfeiting the match.
Therefore, it is crucial both players pay attention that the correct game settings are used.

If any game settings are not mentioned in the list below, they shall be left at the default value.

3.2 Online Qualifier Format

All matches in the Online Qualifier will be played in a Single Elimination bracket on the FACEIT platform as Best-Of-One (BO1) matches, except the final round of each Online Qualifier which will be a Best-Of-Three (BO3) series.

3.3 Live Regional Finals Format

All matches for the Double-Elimination bracket portion of the Live Regional Finals will be played as Best-Of-One (BO1) matches. For certainty, the winner of the losers’ bracket must win two (2) consecutive games in the final round of the Live Regional Finals without another loss against the winner of the winners’ bracket in order to win the Live Regional Finals.

3.4 World Finals Format

Each match within the Round Robin stage of the World Finals shall each be played as a Best-Of-One (BO1) match. The top two (2) players, as set forth above, will advance to a Best-Of-Three (BO3) final round.
3.5 After Successful Qualification

If a Player manages to successfully qualify for the Live Regional Finals by placing top 2 in any of the Online Qualifiers, he or she will be contacted via email by the Sponsor and/or FACEIT on further proceedings and travel arrangements. The email address used to contact the Player will be the one used for registration on the FACEIT platform. Players should ensure they regularly check this email so as to not miss out on any information.

In case there are any question after qualifying, players may reach out to FACEIT directly, using the subject “NHL Qualification” and sending an email to tournaments@faceit.com.
3.6 Travel & Accommodation
Players must be eligible for travel on the dates of the Live Regional Finals and the World Finals. In the event the Player has not reached the age of majority in their jurisdiction, but for clarity, is over the age of sixteen (16), the Player must be accompanied by his/her parent or legal guardian at his/her parent’s or legal guardian’s own expense. Prior to any travel, each qualified Player, or if the Player is a minor the Player’s parent or legal guardian, will be required to sign an Affidavit or Declaration of Eligibility, Liability & Publicity Release or equivalent documents that apply in the Player’s jurisdiction.
Costs
The Sponsor will cover the costs for two (2) nights (i.e., standard hotel, economy class air, rail or other transportation to, and local travel within, the locations of the Live Regional Finals and the World Finals, as determined by Sponsor, and daily per diem) for qualified Players of each of the Live Regional Finals and the World Finals only and, if applicable a Player’s parent or legal guardian will be responsible for his/her own costs. Each respective qualified Player will be responsible for any and all other costs not specified in these Official Rules. Selection of hotel and transportation and all details related to travel will be made in Sponsor’s and/or FACEIT’s sole discretion.
Inability to Travel
In the event a qualified Player is unable or unwilling to travel to the Live Regional Finals, he or she will be replaced by the last Player he/she had beaten in that respective Online Qualifier.
Likewise, should a Player who successfully advanced beyond the Regional Finals be unable or unwilling to travel on to the World Finals, he/she will be replaced by the last Player he/she had beaten in the Live Regional Finals.
In the event the replacement Player(s) is/are unable to advance for any reason, to either the Live Regional Finals or World Finals, Sponsor and FACEIT shall determine another replacement Player(s) based on performance in the Qualifiers or Live Regional Finals in their discretion.
4 Prizes

The three (3) Players that win the Live Regional Finals and the six (6) Players that qualify for the World Finals in accordance with the Official Rules will be considered the Tournament winners (the “Winners,” each a “Winner”) and will be entitled to a prize (each a “Prize, or collectively, “Prizes”). Except where legally prohibited, the Winners (specifically, each winning Player) will be required to complete and return (or have their parent/legal guardian sign if a Winning Player is a minor), an Affidavit or Declaration of Eligibility, Liability & Publicity Release and any required tax documentation in order to claim his/her Prize (if applicable).

In the event that a Winner is disqualified for any reason, such Winner will be deemed to have forfeited the Prize with no further rights and the Prize will be, in Sponsor’s discretion, given to his/her replacement in the case of the Prize for the Live Regional Finals or distributed equally among the remaining Winners as described below in the case of the World Finals. Noncompliance with the foregoing, failure to abide by these Official Rules, or return of the Prize notification as non-deliverable may result in disqualification and naming of a replacement Player. In the event that a Player does not attend, is disqualified or forfeits during the Online Qualifiers and Live Regional Finals, the Sponsor and/or FACEIT may, but are not required to, determine a replacement Player that must satisfy all eligibility requirements of each of the aforementioned stages. In the event that a Player is disqualified during the World Finals, the Sponsor and/or FACEIT will not determine a replacement Player and the Prize will be distributed among the remaining Winners.

THE WINNER(S) IS/ARE SUBJECT TO VERIFICATION BY SPONSOR AND/OR FACEIT, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE TOURNAMENT. A PLAYER IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL PLAYER’S ELIGIBILITY HAS BEEN VERIFIED AND PLAYER HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE, REGARDLESS OF WHAT THE GAME PLAY MAY INDICATE.

For this Tournament, the following Prizes will be available. There will be a total Prize pool of USD $100,000 distributed amongst the three (3) Players who won the Live Regional Finals and the six (6) Players at the World Finals as follows:

3 Live Regional Final Winners: USD $5,000 each

World Finals:
1st Place: USD $50,000
2nd Place: USD $15,000
3rd Place: USD $10,000
4th Place: USD $5,000
5th Place: USD $2,500
6th Place: USD $2,500

Taxes for the Prizes and the travel provided hereunder are the sole responsibility of Winners and/or Players who advance to the Live Regional Finals or the Grand Finals. Approximate Retail Value (“ARV”) of each Prize will be determined by Winner’s allocated portion of the Prize Pool and ARV of respective travel provided is USD $5000 (using a sample Stockholm to Las Vegas itinerary). For any Prize with an ARV of USD $600 or greater, Sponsor will furnish an Internal Revenue Service Form 1099 to a United States Winner, or the relevant tax form to an international Winner (where applicable), for the ARV of Prize and/or any travel provided hereunder for the year in which Prize was won.
5 Console Requirements

The Online Qualifiers will be hosted for both XBOX® and PlayStation® 4 consoles. Each console will have two (2) designated weekends to play the Online Qualifiers all as set forth above.

As soon as the live stage begins with the Live Regional Finals, this will change and the PlayStation® 4 will be used exclusively. XBOX Players may bring their controllers and Sponsor or FACEIT will provide XBOX-PS4 adapters for use on the provided PS4 consoles.

PS4 consoles will be used for all three Live Regional Finals and the World Finals.
By registering for the Online Qualifiers, Players agree to these Official Rules.

Players are not required to bring their PS4 controllers. However, they may choose to use their own, if they prefer.
6 Match Procedure

Once the Tournament goes live, the bracket for each of the Online Qualifiers will be automatically populated with random seeds. Players will be notified of their match via an onscreen popup on FACEIT.com.

By clicking “Go To Match” on this popup, Players are taken to their Match Rooms. Alternatively, Players may navigate to the “Bracket” tab and click their match to get to their Match Rooms.

In the Match Room, there are instructions on how to set up a match. Players will need to follow these instructions and must capture screenshots of the match result.

Once the bracket is live, Players will need to make sure to check back on it regularly to keep track of the other matches in order to anticipate their next opponent. Matches in the following rounds of the bracket will become available and are to be played ASAP - as soon as possible - in order to not delay the tournament.

In case a given qualifier is played out over two (2) days due to bracket size, the tournament overview page (“Round Schedule”) and bracket page will indicate when Day 1 closes and Day 2 commences.

6.1 Before the Match

The Player on the LEFT in the Match Room must host the lobby. It is randomised which Player is set on the left side. The lobby should be created as specified in 3 - Game Settings.

Players have fifteen (15) minutes from creation of the Match Room on FACEIT to start their Online Versus game in NHL 18. If a Player does not show within these fifteen (15) minutes, the Player will forfeit the match. This decision will be made at Sponsor and/or FACEIT’s sole discretion based on these Official Rules.

6.2 During the Match

If a Player is disconnected from a game, the Player will forfeit the game. However, the foregoing is subject to Section 7 below and if there are questions whether the disconnection was intentional, a Player should contact the FACEIT Admin Team through the “CONTACT ADMIN” button inside the Match Room and Sponsor and/or FACEIT may require that a game be restarted or a Player disqualified.

Each Player may pause a game a total of two times for a maximum of :30 seconds per pause. If a Player pauses in excess of that amount, the opponent should contact the FACEIT Admin Team through the “CONTACT ADMIN” button inside the Match Room and Sponsor and/or FACEIT will address in accordance with Section 7 below


6.3 After the Match


Note: It is mandatory for each player to capture a screenshot of the result of each match. Failure to provide proof of the match being played and its result may result in one, or both players, forfeiting the match.

At the end of every match, Players must use the “Set Result” button to manually input the match result into the FACEIT Match Room. The opposing player will then receive a notification in the Match Room of the result having been submitted. From that point on, the opposing player has ten (10) minutes to confirm or dispute the result. Failure to respond to the submitted result within ten (10) minutes will automatically confirm that result. The winning Player MUST provide a screenshot of the match result in a form that can be viewed by Sponsor and FACEIT; however, both Players should capture screenshots of the result, as the Tournament admins may ask for proof in case of any disputes. Player may upload their photos to a public-facing account on imgur.com or another similar site accessible to Sponsor and FACEIT. Failure to provide a screenshot in a form of the match result that can be accessed by Sponsor or FACEIT upon request may result in disqualification.

If both Players do not agree on the outcome of the match, the “CONTACT ADMIN” button in the respective Match Room should be used. Sponsor and FACEIT will determine the winner in their sole discretion based on these Official Rules.

6.4 Match Issues


In the event of any issues, Players should use the “CONTACT ADMIN” button in their respective match rooms for timely assistance.

In general, Players are responsible for ensuring they are ready and able to play their matches at the start of the Tournament. This includes, but is not limited to:

Ensuring a stable internet connection
Ensuring they are able to connect to their XBL / PSN accounts
Ensuring they have all the prerequisites to play an NHL® 18 game on their respective console
Ensuring they are on time

Failure in one or all of these aspects may result in Players’ matches being forfeited.

Between games in a series (BO3), the lobby may be re-hosted in order to fix connection issues. This can be done only in between games of a series, not during an already ongoing game .
If both Players agree, the lobby may be re-hosted by the other Player (right side in the FACEIT Match Room).

In the event of a bug or glitch that affects gameplay, the full match should be played out. Evidence of the bug should be reported to an admin using the “CONTACT ADMIN” button. If the bug is confirmed and is confirmed to have affected the outcome of the game in Sponsor’s or FACEIT’s discretion, the match may be replayed, the results may stand, as determined by Sponsor and/or FACEIT in their discretion, or to the extent that bug is abused, a Player may be disqualified as set forth in 7.1 below.


7 Rules and Violations


7.1 Forbidden in-game actions

The following actions are strictly prohibited during a game and can result in a Player’s account being suspended and the offending Player being disqualified from further participation in the Tournament:

Using any form of external script
Using bugs which change the game principle
Using any 3rd party software that isn't allowed by the game publisher and that can give an unfair advantage to a Player or team
Using any communicative device
Using guest accounts to compete
Not having a full copy of the game
Cheating
Exploiting a bug or glitch in the software
Causing another Player to be dropped or disconnected from the software

7.2 Sanctions

A Player may be cautioned or disqualified if he/she commits any of the following offences:

- Shows dissent by word or action towards other Players or the Tournament Entities.
- Uses insulting language and/or gestures towards other Players or the Tournament Entities
- Is guilty of unsportsmanlike behaviour in a match or otherwise acts in manner that is detrimental to or incompatible with the brand standards of any of the Tournament Entities
- Griefing/Trolling
- Ghosting (i.e. watching video streams and/or listening to live coverage of Player’s own match while the match is still in progress)
- Spamming
- Misleading of Live Support Admins

For the activities referenced in 7.1 and 7.2, issues must be reported to an admin using the “CONTACT ADMIN” button and appropriate evidence needs to be provided.

Decisions are irrevocable and will be executed without delay in Sponsor’s and FACEIT’s discretion. Offending Players may be disqualified from further participation in the Tournament in the sole discretion of the Sponsor and FACEIT.


8 Other


8.1 Stand-ins

Stand-ins are not allowed in the Tournament unless stated otherwise.


8.2 In-Game Name/Avatars

In-Game Names/Avatars are the responsibility of the Players provided, In-Game Names/Avatars shall be consistent with general standards of decency, shall not be derogatory to any Tournament Entities, profane or offensive, shall not violate the proprietary rights of any third party and shall be subject to change as required by the Sponsor and/or FACEIT in their discretion.

8.3 Player Apparel

All apparel worn by Players in connection with the Live Regional Finals and World Finals shall be subject to approval by the Sponsor and FACEIT in their sole discretion. Further, Sponsor and FACEIT may require that specific apparel be worn by Players during the Live Regional Finals and World Finals. By participating, Players agree to wear such required apparel, if applicable.

8.4 Confidentiality

Sponsor and/or FACEIT require that Players not disclose and refrain from communicating (either privately or publicly via social media or otherwise) information related to the Tournament without consent and until after any information related to the outcome of the Tournament has been made public. Players will be required to sign documentation accordingly.

8.5 Player Brand Sponsorship and Promotion

Players may not display or promote any third-party brands without prior approval by Sponsor and FACEIT.


9 Prize Restrictions

Any and all applicable country, federal, provincial, state, and local taxes and all fees, costs and expenses related to acceptance and use of Prize or travel provided hereunder not specifically stated herein as being included as part of the Prize, including but not limited to, VAT taxes, change of air travel fees, ground transportation, automobile insurance, meals, incidentals, passenger tariffs or duties, surcharges, service charges or facility charges, personal charges at lodging, security fees and/or other expenses, are the responsibility solely of winning Players. Prize cannot be substituted, assigned, or transferred by winning Players; however, Sponsor and/or FACEIT reserve the right to make equivalent prize substitutions at their sole discretion. Only the number of Prizes stated in these Official Rules are available to be won in the Tournament. If, by reason of a print or other error, more Prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of Prizes available.

GENERAL CONDITIONS: WARNING: ANY ATTEMPT BY A PLAYER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE AND/OR SPONSOR/FACEIT PLATFORM ASSOCIATED WITH THIS TOURNAMENT OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND/OR FACEIT RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor’s and/or FACEIT’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor and/or FACEIT reserve the right at their sole discretion to disqualify any Player it finds to be attempting to cheat, tamper with or undermine the entry process, the website, and/or the legitimate operation of the Tournament; exploit a bug or glitch in the software; cause another Player to be dropped or disconnected from the software; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person or Player. The failure of Sponsor and/or FACEIT to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor and/or FACEIT (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.

Sponsor and/or FACEIT and their agents are not responsible for (1) any incorrect or inaccurate information, whether caused by Players, printing errors or by any of the equipment or programming associated with or utilized in the Tournament; (2) technical issues or failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or hardware, software or internet issues; (3) unauthorized human intervention in any part of the entry process or the Tournament; (4) technical or human error which may occur in the administration of the Tournament or the processing of game play or registrations or check-ins; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Player’s participation in the Tournament or receipt or use or misuse of any Prize. If technical issues arise, matches should be continued as normal by the Players once such issues are resolved; in the case of a server crash, difficulty in contacting the network or other unforeseen circumstances, it is the Player’s responsibility to contact the Sponsor and/or FACEIT for assistance. For clarity, in Europe, the foregoing will not apply to the extent due to Sponsor’S and/or FACEIT’s gross negligence or wilful misconduct or to the extent resulting in a Player’s bodily injury. If, for any reason, the Tournament is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor and/or FACEIT, which corrupt or affect the operation, administration, security, fairness, integrity or proper conduct of this Tournament, Sponsor and/or FACEIT may, in their sole discretion, void any suspect entries and (a) modify the Tournament or suspend the Tournament to address the impairment and then resume the Tournament in a manner that best conforms to the spirit of these Official Rules in their absolute discretion; and/or (b) award the Prize to an alternate potential Winner in accordance with the Winner selection criteria described above.


10 Publicity

PUBLICITY; LIMITATIONS OF LIABILITY AND RELEASES: BY PARTICIPATING IN THIS TOURNAMENT, EACH PLAYER AGREES THAT TOURNAMENT ENTITIES, AND THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FORANY LIABILITY FOR LOSSES OR DAMAGES OF ANY KIND , (OTHER THAN PERSONAL INJURY OR DEATH) TO PERSONSOR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY OR PARTICIPATION IN THIS TOURNAMENT, HOWEVER PROVIDED THAT NO MEMBER OF THE RELEASED PARTIES ACTED INTENTIONALLY OR WITH GROSS NEGLIGENCE . THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS TOURNAMENT, PLAYER AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES, OR LOSSES OF ANY KIND (OTHER THAN PERSONAL INJURY OR DEATH), INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONSOR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS TOURNAMENT OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE, HOWEVER PROVIDED THAT NO MEMBER OF THE RELEASED PARTIES ACTED INTENTIONALLY OR WITH GROSS NEGLIGENCE.

EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THIS TOURNAMENT SHALL CONSTITUTE AND SIGNIFY THE PARTICIPANT’S AGREEMENT AND CONSENT THAT SPONSOR AND/OR FACEIT AND THEIR DESIGNEES MAY USE THE PARTICIPANT’S NAME, GAMER TAG, NICKNAME OR ALIAS, CITY, STATE, PROVINCE, COUNTRY, IMAGE OR LIKENESS, GAME FOOTAGE (INCLUDING, BUT NOT LIMITED TO, THAT FROM ANY MATCH THAT HAS BEEN LIVE STREAMED, BROADCAST, OR RECORDED), BIOGRAPHICAL INFORMATION AND/OR PRIZE INFORMATION IN CONNECTION WITH THE TOURNAMENT FOR PROMOTIONAL, ADVERTISING OR OTHER PURPOSES, WORLDWIDE, IN ANY AND ALL MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING THE INTERNET, WITHOUT LIMITATION AND WITHOUT FURTHER PAYMENT, NOTIFICATION, PERMISSION OR OTHER CONSIDERATION, EXCEPT WHERE PROHIBITED BY LAW. ALL ENTRIES AND MATERIALS SUBMITTED TO SPONSOR AND/OR FACEIT OR THEIR RESPECTIVE AGENTS IN CONNECTION WITH THE TOURNAMENT (“SUBMISSIONS”), ALONG WITH ALL COPYRIGHT, TRADEMARK AND OTHER PROPRIETARY RIGHTS ASSOCIATED THEREWITH, ARE HEREBY IRREVOCABLY AND FREE OF CHARGE ASSIGNED BY PLAYER TO SPONSOR AND/OR FACEIT UPON SUBMISSION, AND SUBMISSIONS WILL NOT BE RETURNED TO ANY PLAYER. FURTHERMORE, PLAYERS UNDERSTAND THAT SPONSOR AND/OR FACEIT AND/OR THEIR RESPECTIVE AGENTS WILL VIDEO, PHOTOGRAPH AND OTHERWISE DOCUMENT THE TOURNAMENT (“FOOTAGE”). PLAYER AGREES AND CONSENTS THAT, AS BETWEEN THE PARTIES, SPONSOR AND/OR FACEIT SHALL OWN THE FOOTAGE AND SUBMISSIONS AND THAT SPONSOR AND/OR FACEIT, THEIR RESPECTIVE DESIGNEES, ASSIGNEES AND LICENSEES SHALL HAVE THE RIGHT TO EDIT, EXPLOIT, ADAPT, SUBLICENSE, DISTRIBUTE, POST, CREATE DERIVATIVE WORKS FROM, COPY, STORE, OPERATE WITH COMPUTERS AND OTHER DATA PROCESSING EQUIPMENT (E.G. MOBILE PHONES, SMARTPHONES, TABLET PCS, E-PADS OR E-READERS), USE, OFFER AND DISTRIBUTE IN THE INTERNET BY ALL KNOWN MEANS OF TRANSMISSION SUCH AS CABLE, SATELLITE, BROADCASTING SYSTEMS, MAKE PUBLICLY AVAILABLE VIA ALL MEANSUSE THE FOOTAGE OR SUBMISSIONS, IN WHOLE OR IN PART, AND IN COMBINATION WITH OTHER MATERIALS, IN ANY MANNER, FOR ANY ADVERTISING, PROMOTIONAL, TRADE, COMMERCIAL OR OTHER PURPOSES IN ANY AND ALL MEDIA, NOW KNOWN OR HEREAFTER DEVELOPED, WORLDWIDE IN PERPETUITY AND, TO THE EXTENT ALLOWED UNDER THE APPLICABLE LAWS, WITHOUT FURTHER PAYMENT OR CONSIDERATION, NOTIFICATION OR PERMISSION. TOURNAMENT ENTITIES SHALL NOT INCUR ANY LIABILITY WHATSOEVER TO THE EXTENT TOURNAMENT ENTITIES CHOOSE TO REFRAIN FROM ANY EXPLOITATION OF THEIR RIGHTS HEREUNDER. EACH PLAYER WILL INDEMNIFY THE TOURNAMENT ENTITIES, RELEASED PARTIES AND ANY LICENSEE OF SPONSOR AND/OR FACEIT AGAINST ALL CLAIMS, DAMAGES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE COUNSEL FEES AND LEGAL EXPENSES) ARISING OUT OF ANY BREACH OF THESE TERMS.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS TOURNAMENT, INCLUDING EACH WEBSITE ASSOCIATED WITH THIS TOURNAMENT AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. PRIVACY: FACEIT collects the information necessary for it and the Sponsor to operate the Tournament at the time a Player registers his/her FACEIT and XBOX LIVE or PSN account, and without limiting FACEIT’s rights under its Online Privacy Policy, which can be found at https://www.faceit.com/en/fit/privacy, FACEIT and the Sponsor will use such information to contact a Player for matters and events related to the operation of this Tournament.  Information collected from each Player will be shared with the Sponsor of the Tournament, whose Online Privacy Policy can be found at: https://www.nhl.com/info/privacy-policy.

In the United States, Players agree that Sponsor and/or FACEIT and their agents, affiliates, subsidiaries, representatives or service providers may use Players’ personal information submitted with entry for purposes of future marketing by Sponsor and/or FACEIT, such as to notify them of a product or promotion that Sponsor and/or FACEIT think may be of interest. Please see each of FACEIT’s and the Sponsor’s Privacy Policies for information about the choices that may be available to you to opt out of such promotional communications.  By participating in this Tournament, each Player acknowledges his/her agreement to the terms of Sponsor’s and FACEIT’s Privacy Policies.

DISPUTES: Except where prohibited, Player agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Tournament or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts situated in New York, NY; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Tournament, but in no event solicitors/attorneys’ fees or other costs of bringing a claim; (3) under no circumstances will Player be permitted to obtain awards for, and Player hereby waives all rights to claim, indirect, punitive, incidental, exemplary, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased, and, (4) in no event shall Players rescind this agreement or seek injunctive or any other equitable relief. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, and/or the rights and obligations of the Player and Sponsor and/or FACEIT in connection with the Tournament, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than that of New York.

WINNER ANNOUNCEMENT: For the names of the Winners, available after June 19, 2018 send a self-addressed, stamped envelope to be received by July 19, 2018 to: NHL, 1185 Avenue of the Americas, New York, NY 10036 (USA), Attn: NHL gaming world championship Tournament. Residents outside of the United States may omit return postage.
